    Construction Contracts (Why Bother?) and Lien Rights (Do I Have Them?) for Design Professionals

    This seminar will provide information on lien rights and breach of trust provisions under the Act. The Top five (or 10) contractual words or clauses to watch out for in a contract and are of particular concern to design professionals will be identified. Holdbacks - when to have and not to have - will be examined.  "We'll pay you when we get paid" vs. getting paid according to percentage completion of the work per contract and its legal ramifications will be discussed. Document retention requirements and the use of digital documents will also be discussed.

    Gregory D. Hersen is a partner of Torkin Manes LLP and Chair of the firm's Construction Law practice group. He is certified by The Law Society of Upper Canada as a Specialist in Construction Law. Greg is a Past Chair of the Ontario Bar Association's Construction Law Section and continues to be an executive member of both the OBA and CBA Construction Law Sections. He practices exclusively in the area of construction law, on behalf of public and private owners, general contractors, sureties, subcontractors, suppliers, financial institutions and design professionals. Greg's practice includes all aspects of construction document drafting and construction claims, defences and surety bond work, employing alternative dispute resolution, and advocacy at trial and appellate levels. Greg was the first lawyer to be appointed as a member of the Canadian Construction Documents Committee (CCDC) where he participated in the revision and development of standard CCDC construction contracts, including the CCDC 2 - 2008 Stipulated Price Contract, and other documents. Greg was a member of the CCDC and its Surety Subcommittee from 1998 until 2008. Greg regularly presents seminars to clients, educational institutions and professional groups, including design professionals and speaks at Continuing Legal Education Programmes presented by the Ontario Bar Association and The Law Society of Upper Canada on a variety of construction law topics.
